These Terms and Conditions ("Terms") govern your use of the DocLokr platform and the DocLokr SMS Notifications program operated by DocLokr ("we," "us," or "our"). By creating an account, providing your mobile number, or otherwise using our services, you agree to these Terms. If you do not agree, do not use the service.
1. The Service
DocLokr is a secure platform for verified document exchange. Senders initiate a "Locker" addressed to a specific receiver. The receiver verifies their identity biometrically before any sensitive instructions or documents are exchanged. The service is intended for users who agree to these Terms and our Privacy Policy.
2. SMS Notifications Program
Program name: DocLokr SMS Notifications.
Description: Transactional text messages containing a secure link to a document locker that has been shared with you. These are one-time, account-related messages. They are never marketing and are never recurring.
How to opt in: You opt in yourself, on a DocLokr web page. A professional firm using DocLokr emails you a three-word passphrase; that email contains no link. You go to doclokr.com, choose I Have a Pass Phrase, enter the passphrase, then confirm your own mobile number — shown to you as its last four digits — and check a consent box that is unchecked by default. No text message is sent until you check that box and submit the form. While our messaging campaign is being reviewed, no text messages are sent at all; your secure link is emailed to you instead, after you have opted in. Message frequency: One message per document exchange.
Message and data rates: Message and data rates may apply. Charges depend on your mobile carrier and plan. DocLokr does not charge a fee for sending SMS notifications, but your carrier may.
How to opt out: Reply STOP to any DocLokr SMS at any time. You will receive a confirmation message and no further SMS notifications will be sent. To resubscribe, reply START, or complete the consent step again the next time a document exchange is shared with you.
Mobile information: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. See our Privacy Policy for details.
How to get help: Reply HELP to any DocLokr SMS for support information, or email support@doclokr.com.
Carriers: Supported carriers include AT&T, Verizon Wireless, T-Mobile, Sprint, Boost Mobile, U.S. Cellular, MetroPCS, and most other major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
3. Eligibility
You must be at least 18 years old and able to enter into a binding contract to use DocLokr. By using the service, you represent that you meet these requirements and that the information you provide is accurate and current.
4. Account Security
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately at support@doclokr.com if you suspect unauthorized access to your account.
5. Acceptable Use
You agree not to:
- Use DocLokr to send fraudulent, misleading, or unlawful content.
- Impersonate any person or entity, or misrepresent your identity in a Locker exchange.
- Attempt to access accounts, data, or systems you are not authorized to access.
- Interfere with the operation of the service, including by introducing malware or attempting to disrupt service availability.
- Use the service to send messages that violate our SMS Notifications program scope or any applicable law.
6. Privacy
Our handling of personal information is described in our Privacy Policy. By using DocLokr, you agree to the data practices described there.
7. Service Availability
We work to keep DocLokr available and reliable, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the service at any time. We are not liable for delays, failures, or message delivery issues caused by carriers, third-party providers, or events outside our control.
8. Disclaimer of Warranties
DocLokr is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the fullest extent permitted by law, DocLokr will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service. Our total liability for any claim related to the service will not exceed one hundred U.S. dollars ($100).
10. Termination
You may stop using DocLokr at any time. We may suspend or terminate your access if you violate these Terms or engage in activity that harms the service or other users. On termination, your right to use the service ends, and we may delete associated data as described in our Privacy Policy.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the application or by other reasonable means. Your continued use of the service after the effective date of the updated Terms constitutes your acceptance of them.
12. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Any disputes arising from these Terms or your use of DocLokr will be resolved in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts.
